A Tesla Model X owner took legal action against Tesla Motors on Friday, the owner stated his electrical SUV unexpectedly sped up while being parked, triggering it to crash through the garage into owner’s living-room, hurting the motorist and a passenger.

The Model X owner, Ji Chang Son, stated that during a night in September, he slowly pulled into his driveway as his garage door opened when the vehicle all unexpectedly sped forward.

“The car spontaneously started to speed up at full power, jerking forward and crashing through the interior wall of the garage, ruining a number of wood support beams in the wall and a steel sewage system pipeline, to name a few things, and coming to rest in Complainants’ living-room,” the lawsuit stated.

The lawsuit, submitted in U.S. District Court in the Central District of California, looks for class action status. It mentions 7 other complaints submitted in a database put together by the National Highway Traffic Safety Administration (NHTSA) handling abrupt acceleration without warning.

The lawsuit declares product liability, negligence and breaches of guarantee, and looks for undefined damages.

The high-end Model X, introduced in late 2015 X, was Tesla’s very first sport utility vehicle.

In its marketing, Tesla declares the Model X is the safest SUV in history.
