Fisker in trouble, staff plans to file federal lawsuit

Fisker Automotive in news again and this time again it is not a good news. The company had recently announced that they have fired around 75% of their staff. Now the staff is planning to file a federal lawsuit for firing them.

The workers are claiming that the company had fired them without any prior notification and this leads to breach of America’s and California’s Worker Adjustment and Retraining Notification (WARN) Act. The Act states that employees must be notified 60 days prior to having their contracts terminated.

They also claiming that the employees were not given any severance packages, again as per the requirement, and so the company becomes liable to continue to pay these workers for these additional 60 days and may also have to give additional compensation for failing to adhere to the WARN Act.

If the non-compliances are proved, Fisker Automotive will be liable to pay a $500 penalty to each fired employee for every day it fails to comply.
